The European Union Commission’s whitepaper on Artificial Intelligence proposes shaping the emerging AI market so that it better reflects common European values. It is a master plan that builds upon the EU AI High-Level Expert Group guidelines. This article reviews the masterplan, from a culture cycle perspective, to reflect on its potential clashes with current societal, technical, and methodological constraints. We identify two main obstacles in the implementation of this plan: the lack of a coherent EU vision to drive future (...) decision-making processes at state and local levels and the lack of methods to support a sustainable diffusion of AI in our society. The lack of a coherent vision stems from not considering societal differences across the EU member states. We suggest that these differences may lead to a fractured market and an AI crisis in which different members of the EU will adopt nation-centric strategies to exploit AI, thus preventing the development of a frictionless market as envisaged by the EU. Moreover, the Commission aims at changing the AI development culture proposing a human-centred and safety-first perspective that is not supported by methodological advancements, thus taking the risks of unforeseen social and societal impacts of AI. We discuss potential societal, technical, and methodological gaps that should be filled to avoid the risks of developing AI systems at the expense of society. Our analysis results in the recommendation that the EU regulators and policymakers consider how to complement the EC programme with rules and compensatory mechanisms to avoid market fragmentation due to local and global ambitions. Moreover, regulators should go beyond the human-centred approach establishing a research agenda seeking answers to the technical and methodological open questions regarding the development and assessment of human-AI co-action aiming for a sustainable AI diffusion in the society. In the years 1777–1778 four volumes were published under the title Legal Observations on Several Dark and Until Now Unverified Sections of the Introduction. The volumes were composed by a society of young legal practitioners from The Hague, the most famous among them being Joannes van der Linden. By then Grotius’s Introduction to the Jurisprudence of Holland was still the cornerstone of the law of Holland and around the year 1800 it would become the fundament for attempts to codify this (...) law. Today the Legal Observations can function as entrance to the historical sources of the law of Holland as described by Grotius and developed further after publication of his Introduction. (shrink)

This paper presents a novel proof of the conservativity of the intuitionistic theory of strictly positive fixpoints, $$\widehat{{\textrm{ID}}}{}_{1}^{{\textrm{i}}}{}$$ ID ^ 1 i, over Heyting arithmetic ($${\textrm{HA}}$$ HA ), originally proved in full generality by Arai (Ann Pure Appl Log 162:807–815, 2011. https://doi.org/10.1016/j.apal.2011.03.002). The proof embeds $$\widehat{{\textrm{ID}}}{}_{1}^{{\textrm{i}}}{}$$ ID ^ 1 i into the corresponding theory over Beeson’s logic of partial terms and then uses two consecutive interpretations, a realizability interpretation of this theory into the subtheory generated by almost negative fixpoints, and (...) a direct interpretation into Heyting arithmetic with partial terms using a hierarchy of satisfaction predicates for almost negative formulae. Bohr’s work in quantum mechanics posed a challenge to philosophers of science, who struggled with the question of whether and to what degree his theories and methods could be considered rational. This paper focuses on Popper, Feyerabend, Lakatos and Kuhn, all of whom recognized some irrational, dogmatic, paradoxical or even inconsistent features in Bohr’s work. Popper, Feyerabend, and Lakatos expressed strong criticism of Bohr’s approach to quantum physics, while Kuhn argued that such criticism was unlikely to be fruitful: progress in (...) science is generally not made through philosophical reflection. Feyerabend’s criticism of Bohr gradually weakened, as he gained a more detailed understanding of the development of Bohr’s views on quantum mechanics, and this went together with an increasingly critical view of normative philosophy of science and was instrumental to his conversion to ‘anarchism’. This paper aims to show that quantum mechanics played a central role in their debates and disagreements on the rationality of science and the possibility of a normative philosophy of science. Context: Strict finitism is usually not taken seriously as a possible view on what mathematics is and how it functions. This is due mainly to unfamiliarity with the topic. Problem: First, it is necessary to present a “decent” history of strict finitism and, secondly, to show that common counterarguments against strict finitism can be properly addressed and refuted. Method: For the historical part, the historical material is situated in a broader context, and for the argumentative part, an evaluation of arguments (...) and counterarguments is presented. Results: The main result is that strict finitism is indeed a viable option, next to other constructive approaches, in mathematics. Implications: Arguing for strict finitism is more complex than is usually thought. For future research, strict finitist mathematics itself needs to be written out in more detail to increase its credibility. In as far as strict finitism is a viable option, it will change our views on such “classics” as the platonist-constructivist discussion, the discovery-construction debate and the mysterious applicability problem . Constructivist content: Strict finitism starts from the idea that counting is an act of labeling, hence the mathematician is an active subject right from the start. It differs from other constructivist views in that the finite limitations of the human subject are taken into account. (shrink)

Although the critical reconceptualization of Corporate Citizenship (CC) proposed by Néron and Norman appropriately focuses on connotations that enable us to distinguish between CC and the all-inclusive notion of Corporate Social Responsibility (CSR), I argue that they fail to properly account for the misguiding potential of the features of political citizenship they propose to develop further in CC theorizing. It is concluded that the notion of CC is better dispensed with altogether, and that a reorientation on concepts that can truly (...) transcend the boundaries of economic and political organization would benefit the field of business and society. Assume that water reduces to H2O. If so water is identical to H2O. At the same time, if water reduces to H2O then H2O does not reduce to water–the reduction relation is asymmetric. This generates a puzzle–if water just is H2O it is hard to see how we can account for the asymmetry of the reduction relation. The paper proposes a solution to this puzzle. It is argued that the reduction predicate generates intensional contexts and that in order to account (...) for the asymmetry, we should develop conditions on the meanings of expressions that flank the reduction predicate in true reduction statements. Finally, it is argued that if we adopt this interpretation, we can illuminate the epistemological difference between reduced and reducing item commonly referred to in the literature. (shrink)

In computer ethics, as in other branches of applied ethics, the problem of the justification of moral judgment is still unresolved. I argue that the method which is referred to as “The Method of Wide Reflective Equilibrium” (WRE) offers the best solution to it. It does not fall victim to the false dilemma of having to choose either case‐based particularist or principle‐based universalist approaches to the problem of moral justification. I claim that WRE also provides the best model of practical (...) moral reasoning available for computer ethics. It does not pretend to provide quasi‐algorithmic procedures for moral decision‐making, but neither does it abandon the regulative ideal of communicative transparency in discursive public justification. Rational agents base their actions on information from observation, inference, introspection, or other sources. But this information comes in different kinds, and it is usually handled by different logical mechanisms. We discuss how to integrate external ‘updating information’ and internal ‘elucidating information’ into one system of dynamic epistemic logic, by distinguishing two basic informational actions: ‘bare seeing’ versus ‘conscious realization’.

ABSTRACT Over the past few decades the concept of (human) dignity has deeply pervaded medical ethics. Appeals to dignity, however, are often unclear. As a result some prefer to eliminate the concept from medical ethics, whereas others try to render it useful in this context. We think that appeals to dignity in medical ethics can be clarified by considering the concept from an historical perspective. Firstly, on the basis of historical texts we propose a framework for defining the concept in (...) medical debates. The framework shows that dignity can occur in a relational, an unconditional, a subjective and a Kantian form. Interestingly, all forms relate to one concept since they have four features in common: dignity refers, in a restricted sense, to the ‘special status of human beings’; it is based on essential human characteristics; the subject of dignity should live up to it; and it is a vulnerable concept, it can be lost or violated. We argue that being explicit about the meaning of dignity will prevent dignity from becoming a conversation‐stopper in moral debate. Secondly, an historical perspective on dignity shows that it is not yet time to dispose of dignity in medical ethics. At least Kantian and relational dignity can be made useful in medical ethics. When is an argument to be called one-sided? When is putting forward such an argument fallacious? How can we develop a model for critical discussion, such that a fallaciously one-sided argument corresponds to a violation of a discussion rule? These issues are dealt with within ‘the limits of the dialogue model of argument’ by specifying a type of persuasion dialogue in which an arguer can offer complex arguments to anticipate particular responses by a critic.

The European Corporate Sustainability Framework (ECSF) is a new generation management framework, aimed to meet increased corporate complexity and support corporate transformation towards more sustainable ways of doing business. Labeled transition systems are key structures for modeling computation. In this paper, we show how they lend themselves to ordinary logical analysis (without any special new formalisms), by introducing their standard first-order theory. This perspective enables us to raise several basic model-theoretic questions of definability, axiomatization and preservation for various notions of process equivalence found in the computational literature, and answer them using well-known logical techniques (including the Compactness theorem, Saturation and Ehrenfeucht games). Moreover, we consider what happens to this (...) general theory when one restricts attention to special classes of transition systems (in particular, finite ones), as well as extended logical languages (in particular, infinitary first-order logic). We hope that this puts standard logical formalisms on the map as a serious option for a theory of computational processes. As a side benefit, our approach increases comparability with several other existing formalisms over labeled transition systems (such as Process Algebra or Modal Logic). Although McMahon offers a potentially valuable extension of Joseph Raz's conceptualization of authority by distinguishing three different kinds of authority, this paper argues, first, that his account of the conditions and considerations that would justify managerial authority is problematic because it relies on a conception of reasons for action that excludes precisely the kind of rationality that plays an important role in the␣explanation and justification of authority in economic␣organization. This paper explains, second, why McMahon's thesis of the justificatory similarity of (...) authority in governments and nongovernmental organizations can also be seen to hold for corporate governance of publicly owned firms more specifically. Finally, this paper raises some critical objections against McMahon's presumption of democratic governance in governments and NGO's alike. The thrust of these objections is that democratic corporate governance does not make sense in the publicly owned firms because: it will not produce results that are fair or welfare maximizing, and it will undermine the legitimacy of managerial authority in such firms. Gödel once offered an argument for the general reflection principle in set theory that took the form of an analogy with Leibniz' Monadology. I discuss the mathematical and philosophical background to Gödel's argument, reconstruct the proposed analogy in detail, and argue that it has no justificatory force.

Since the mid-1990s most EU Member States have established a national forensic DNA database. These mass repositories of DNA profiles enable the police to identify DNA stains which are found at crime scenes and are invaluable in criminal investigation. Governments have always brushed aside privacy objections by stressing that the stored DNA profiles do not contain sensitive genetic information on the included individuals and that they reside under the statutory privacy protection regulations. However, it has been generally overlooked that the (...) police also store the DNA samples from which the DNA profiles are derived. Although these DNA samples are actually a potential source of genetic information, they have so far scarcely been the subject of discussion. In this article we will show that both European and national regulations offer inadequate protection to completely prevent function creep, that is, the use of these forensic DNA samples for purposes beyond those envisaged at the time of collection. Aan de hand van recente ontdekkingen op het gebied van neurowetenschappen, biologische evolutie, paleontologie, evolutionaire psychologie en evolutionaire dynamicamodellen, leggen Dirk Van Duppen en Johan Hoebeke uit hoe pro-sociale gedragingen en altruïsme het succes van de ‘homo sapiens’ evolutionair hebben bepaald. Vermits de mens als meest kwetsbaar en meest prematuur dier op de wereld is gekomen, was zijn enige manier om te overleven een biologisch-culturele co-evolutie waarbij zijn intelligente vermogens zich enkel konden ontwikkelen door zijn ingeslepen drang om zich sociaal (...) te gedragen. Dit wetenschappelijk gegrond beeld van de ‘homo sapiens’ staat volledig haaks op dit van de neoliberale ‘homo economicus’ die enkel op individuele winstmaximalisatie gericht is en op de competitiedrang, die als enige drijfkracht voor de vooruitgang wordt beschouwd. De discrepantie tussen de biologisch-culturele fundamenten van onze soort en de actuele overheersende ideologie waaraan wij continu onderworpen worden, zou het stijgend ongenoegen en het ‘mal vivre’ in onze maatschappijen kunnen verklaren. Zoals José Saramago het uitte: ‘Als de omstandigheden zo bepalend zijn voor de mens, laat ons dan die omstandigheden meer menselijk maken.’. (shrink)

In a rarely quoted paper, published in 1958 in the American Journal of Physics, T. Ehrenfest-Afanassjewa introduced the idea that the concept of chance as employed in physics is subject to what she called a ‘Limited Belief in Chance’. In this paper I elaborate the latter concept and the distinction between absolute chance and relative randomness, where the latter, but not the former, is governed by the theory of probability. I argue that in the twentieth century virtually nobody believes seriously (...) in the possiblity of absolute chance, whereas the concept of chance in the Scientific World Picture is only ‘chancy’ relative to a limited belief in chance grounded in the Manifest World Picture of an orderly world.
